CBP, ICE, and USCIS Announce Crackdown on Visa Overstays

investigation-9604083_1280On June 4, 2025, the Department of Homeland Security (DHS) announced that the agency will expand its efforts to crackdown on visa overstays, due to a recent terrorist attack in Boulder Colorado. The attack was perpetrated by an Egyptian national who had been in the United States unlawfully since overstaying his visa in 2022.

What this Means

  • Swift policy action: Under Secretary of Homeland Security Kristi Noem’s directive, federal partners are now reviewing immigration files more aggressively, identifying visa overstays, and initiating enforcement actions
  • Aggressive policies: In the announcement, Secretary Noem stressed there’s “NO room in the United States for the world’s terrorist sympathizers,” asserting, “Anyone who thinks they can come to America… will be found, deported, and prosecuted to the fullest extent”

What to Expect

As part of the federal government’s intensified enforcement efforts, immigration agencies plan to increase the frequency and depth of record reviews by conducting more thorough cross-checks of immigration databases.

Individuals identified as having overstayed their visas may be issued Notices to Appear (NTAs), placing them into removal proceedings. In addition, CBP, ICE, and USCIS will enhance interagency coordination to improve the efficiency and effectiveness of detecting visa overstays and carrying out enforcement actions.

Individuals who may have overstayed their visas are strongly encouraged to consult with an experienced immigration attorney to discuss legal avenues to remain in the United States and develop a clear plan in case they are detained by immigration authorities.
