The American Immigration Lawyers Association will be hosting a free workshop on September 19, 2015 at various sites around the country.  The workshop will be providing assistance to lawful permanent residents who are eligible for naturalization. Each year, at sites across the country, AILA attorneys and other stakeholders provide assistance to lawful permanent residents eligible for naturalization.  Last year, AILA and its partner “ya es hora ¡Ciudadanía!” held more than 50 naturalization clinics in 22 states and the District of Columbia serving thousands of immigrants who aspired to become citizens. In order to alleviate the workload received by the Vermont Service Center, USCIS recently announced that some cases normally processed at the Vermont Service Center will be transferred to the California Service Center. Cases that may be affected include I-130 petitions for alien relatives and I-751 petitions to remove the conditions on permanent residence.

For cases that are transferred to the CSC, USCIS will issue applicants a receipt notice confirming the transfer of their application. The transfer notice will include the date of transfer and the new location where the application will be processed. The receipt number identifying your application will remain unchanged. There may be a slight delay in the processing time for cases that are transferred to a new location.

CIS has clarified that the filing location for I-130 and I-751 applications will remain the same and applicants should continue to follow the form instructions before filing their applications with CIS.

Applicants can check the status of their applications by navigating to the CIS website and entering their receipt number in the Case Status Online system. Applicants are also encouraged to continue to check the processing times published on the CIS website for the California Service Center or by calling the National Customer Service Center at 1-800-375-5283. If your application is outside of the normal processing time you should submit an e-Request inquiry on the CIS website or by calling the NCSC. When submitting the e-Request by telephone you must have your receipt number on hand and notify the customer service representative that your application has been transferred to a new location.

It is our pleasure to provide our readers with newly released statistics published by the Department of Labor’s Office of Foreign Labor Certification concerning the processing status of the PERM program and Prevailing Wage Determinations. The PERM graphic provides a breakdown for the review of applications certified during FY 2015 by the top 5 occupations, site states, industries, visa classifications, countries of citizenship, and minimum educational requirements. The graphic concerning the National Prevailing Wage Center outlines the determinations requests received for the H-1B program H-2B program, and PERM program FY 2015, breaks down prevailing wage actions, and issuance of prevailing wage determinations for PERM top 5 employers and occupations, H-1B top 5 employers and occupations, and H-2B top 5 employers and occupations.

The Department of State has issued an alert announcing that as of June 26, 2015 all visa issuing US embassies and consulates are now able to continue visa processing. Staff at US consulates and embassies were able to work over the weekend and resolve backlogs which are expected to be eliminated this week.

As you may recall between the time period of June 9, 2015 to June 19, 2014, 335,000 visas were unable to be printed due to clearance and technological issues. Of those 335,000 visas, approximately 300,000 have now been printed.

Consulates and embassies worldwide are now scheduling visa interviews and issuing non-immigrant and immigrant visas.

Technical issues experienced at U.S. Consulates worldwide

1. In regards to technical issues causing delays in visa issuance at U.S. Consulates worldwide, visa issuance is currently frozen. No visas are currently being issued at any U.S. Consulates worldwide. U.S. Consulates are rescheduling appointments for visas that were affected by the technical issues. The DOS is working to repair the hardware, however it will not be until next week when all issues will be resolved. Due to this, there will be a backlog for visa issuance and it will take longer to schedule a consular appointment for a visa.

2. If a visa applicant was affected by the technical issues at a U.S. Consulate abroad and they need to retrieve their passport urgently, they will be able to retrieve their passport, however, in doing so, applicants will forfeit the visa fees they have paid, and will be issued a 221(g) visa denial letter. If applicants are still interested in receiving a visa, they must re-apply and re-pay any visa fees. Applicants who are re-applying must note on future applications that their visa was denied due to a technical glitch. Applicants from visa waiver countries who are concerned that the visa denial will automatically result in an ESTA denial can rest assured. ESTA submissions will not be denied based on the technical glitch. DOS has responded that the technical issues will not affect future visa applications. Continue reading

Q: I am visiting the United States as a tourist from a non-visa waiver country. My duration of stay will expire in approximately 1 month. Is it possible for me to extend my stay in the United States?

A: Yes, it is possible to extend your duration of stay if you plan to remain in the United States for purposes of tourism, leisure, or medical treatment. In order to extend your duration of stay you must file Form I-539. The process can be confusing for some, we recommend that all applicants seek counsel from an accredited legal representative or attorney to guarantee success.  In order to extend your duration of stay, you must be able to provide documentation proving that they have strong ties home including but not limited to: proof of employment, proof of academic enrollment, deed of property ownership, proof of financial obligations, etc. You must also be prepared to provide documented evidence supporting the fact that your stay will be for temporary purposes of tourism and/or leisure including a detailed personal statement establishing the fact that you will be in the United States for a temporary period of time, and will be returning back to your home country at the conclusion of your trip. Lastly, you must provide evidence that you have the sufficient finances to support yourself in the United States. The more evidence you can provide to support your claims, the better chances of your application being approved.

If a petitioner filed an FY16 H-1B cap petition in a timely manner for the fiscal year 2016 and has received notification from the delivery service used suggesting that there may be a delay or damage to the package, the petitioner may file a second H-1B petition.

The second H-1B petition must contain the following: a new fee payment, an explanation as to why a second petition is being filed with supporting evidence (such as the notice from the delivery service), and a request to withdraw the first petition.

If a second petition is sent without these items, it will considered a duplicate filing. USCIS would like to remind employers that it will deny or revoke petitions that are filed in the multiple or duplicate by an employer in the same fiscal year for the same H-1B employee, and they will not refund the filing fees.

Our firm has started to work on H1B visa applications for our clients. We want to be sure none of our clients miss the April 1st deadline. April 1 is the date when H-1B can be filed at the earliest. Only 65,000 visas are available for applicants with a Bachelor’s Degree and 20,000 for applicants with a Master’s degree. Last year, USCIS had received too many applications by April 11. Since the economy is improving, we expect that the H-1B cap will be reached very fast.

Once you apply on April 1, if your case is approved, you can start working on H-1B status as of October 1, 2015.

If you think you qualify for H-1B, here are some steps to follow for a successful H-1B application:

  • First you must have a H-1B petitioner:

You cannot petition yourself for a H-1B, unless you own your own company. A company must petition you, which will include providing their EIN number, signing the different forms and issuing the checks made payable to the U.S Department of Homeland Security. Once the H-1B is approved, the petitioner must abide by the conditions described in the H-1B application and do the proper recordkeeping.
